Facts

On June 11, 1996, arsonist set fire to an apartment building basement. The arsonist gained entry to the basement
through an open and inoperative door, about which numerous tenants had previously complained. The
plaintiffÆs alleged negligent security for the third party criminal acts of the arsonist and general negligence for
allowing debris to accumulate in the basement area for which the fire department had cited the building on
several occasions prior to the fire.

Damages

Of the 26 plaintiffs, some suffered smoke inhalation and emotional distress. Most of their claims were based upon property damage.

Other Information

The case settled for $400,000 on the first day of jury selection.
