Facts

The plaintiff class members were tool dealers in the period of 1981 through 1996. Defendant insurance company
provided inventory coverage for tool dealers under a master policy from 1992-96. Defendant tool company
issued insurance certificates to the dealers that did not disclose that the first $100,000 inventory coverage was
subject to a deductible paid by the tool company and that the tool company participated in adjusting and paying
claims within the deductible. The tool company was not a licensed insurance carrier.
The plaintiff filed claims for conversion, fraud and civil RICO.

Other Information

The court approved the class action settlement.
