Facts

The plaintiff owns the Broadway Plaza in El Cajon. From 1983 to 1994, the defendant was the property
manager. During his time as property manager, the defendant diverted net profits generated by the Broadway
Plaza into a money market account, from which he withdrew over $500,000. The defendant claimed to have an
oral joint venture/partnership agreement with the plaintiff. The plaintiff denied having any such agreement.

Damages

The plaintiff claimed damages of $502,510 in principal; $424,274 in interest; $100,000 in emotional distress; $26,500 in rent and $500,000 in punitive damages.

Other Information

The verdict was reached approximately five years after the case was filed. The case was stayed pending determination by the District AttorneyÆs office.
