Facts

The plaintiff was an editor in the television industry. He was hired by defendant. One week into his employment
on the show, the plaintiff stated that he was not willing to work nights.
The plaintiff contended that the defendant insisted that the plaintiff would have to work nights if he wanted to
continue his employment. The plaintiff quit his position rather than work nights. The defendant thereafter
found substitute employment for the plaintiff on another show.

Settlement Discussions

The defendants offered $8,800 on the eve of trial and the plaintiff refused the offer. The plaintiff made no counter offer.

Result

The defendants moved for a directed verdict at the close of evidence, which was granted.
