On April 15, 1999, the plaintiff, a 36-year-old physician, was a guest of defendant hotel and was severely injured
when the right foot strap on a stationary Lifecycle 9100, located in the defendantÆs health club, snapped apart
and broke.
The pedal continued and the motion caused the plaintiffÆs right knee to hyper-extend, resulting in a complete
tear of the posterior horn of the lateral meniscus requiring surgical intervention.
The plaintiff subsequently underwent right knee arthroscopy with intra-articular surgery on July 3, 1999. Post-
operatively, he was seen on July 6, at which time he was having decreased pain and was able to ambulate with
less discomfort.

Settlement Discussions

The plaintiff informally demanded $150,000 to resolve the claim. The defendant offered $95,000.
