Facts

The plaintiffs were 39-year-old mother and her three children, all girls, ages, 6, 8 and 11. The mother was driving
her children to school at which time the defendant driver ran a red light at the intersection, hitting the
plaintiffsÆ vehicle broadside, causing it to spin and be impacted again by the defendantÆs vehicle. Prior to
defendantÆs deposition, the defense counsel stipulated in writing to liability.

Settlement Discussions

The plaintiffs made C.C.P. Section 998 demand as follows: $175,000 (mother); $30,000 (11 years old); $20,000 (6 years old); $15,000 (8 years old). The offers were rejected. The parties went to a mediation before Steven Sauer, which did not result in a settlement initially although at the mandatory settlement conference follow-up negotiations were conducted through mediation which resulted in the reported settlement.

Injuries

The mother suffered soft tissue injures to her neck and back, head lacerations and corneal abrasion which healed. She was brought to emergency room and followed up with physical therapy. She also went to a plastic surgeon for laser surgery to reduce the scarring on her forehead. She was left with residual scarring on the forehead. She also suffered post-traumatic stress disorder. The three minor children suffered soft tissue injuries. The 11-year-old also suffered psychological trauma from the accident.
