Facts

The plaintiff, a medical doctor, was a driver of a 1997 Jeep Grand Cherokee, traveling
eastbound on the 60 freeway. The defendant was the driver of a 1998 Honda Civic, engaged in a
speed contest traveling eastbound on the 60 freeway. The plaintiff contended that the defendant
negligently cross over four lanes of traffic and smashed into the plaintiffÆs vehicle, causing
plaintiff to spin out on the freeway. The defendant admitted liability at the mediation.

Settlement Discussions

The plaintiff demanded $30,000, not including punitive damages. The defendant offered $15,000 (policy limits).
