Facts

The plaintiff, a 69-year-old female reportedly slipped and fell at the defendant nursing home. The
treating neurosurgeon was of the opinion that the plaintiffÆs injuries were not inconsistent with a
beating and that the injuries occurred over a period of time.

Settlement Discussions

The parties settled for $405,000, $400,000 being paid by the defendant nursing home and $5,000 by the defendant HMO.

Specials in Evidence

$25,000 in excess of $200,000

Injuries

Sub frontal cortex bruising, subdural hematoma, right parietal bleeding, basal skull fracture, temporary partial paralysis, spasticity and rigidity.
