Facts
On Feb. 27, 2000, the plaintiff was taken by ambulance to the Emergency Room at Brea Community Hospital
with a chief complaint of syncope and generalized weakness. Following a physical examination, chest X-ray,
CT scan and laboratory work, he was diagnosed with uncontrolled diabetes, anemia, sinusitis, and
hyperosmolarity. He was discharged home with instructions to see his own doctor as soon as possible.
The next day, he felt worse and he noticed some blurry vision. He went to the clinic at
UCI, but left when he learned that his doctor was not in. He went home and when he awoke the
next day he felt worse. His family took him to the Emergency Room at UCI and following an
examination, he was immediately admitted to the hospital. Testing revealed a GI bleed. In
addition, his vision had deteriorated to the point where he had lost the lower field of vision in his
left eye. That condition was diagnosed as ischemic optic neuropathy (loss of blood to the optic
nerve).

The plaintiff submitted a demand of $80,000; there was no offer.
