The plaintiff, a disability advocate, visited a restaurant owned by the defendant. The plaintiff claimed that he was discriminated against because the service counter was too high and the seating in the restaurant was inaccessible. The plaintiff instituted a lawsuit against the defendant in which he alleged violations of the Americans with Disabilities Act, the Unruh Act and California Disabled Persons Act.
