Facts

The plaintiff stopped on the I-405 freeway at the 101 exit and in the number one lane, while an accident in front of him was cleared. An excavation pickup truck owned by the defendant trucking company was southbound on the I-405. The driver of the defendant's truck rear-ended a moving van driven by a third party. That, in turn, caused the plaintiff to be rear-ended and he suffered significant personal injuries as a result of the collision. The defendant admitted liability.

The defendant trucking company tendered its $1 million policy limits.
