In December 2001, plaintiff Thomas Flynn, a 48-year-old salesman, was shopping in a Petco store in Newport Beach. The plaintiff claimed that when he turned to walk down a store aisle, he tripped over boxes of dog food that had been left in the aisle and injured his right hand. The plaintiff sued defendant Petco Animal Supplies Inc., alleging premises liability.
