Facts

In June 2001, George Jones, a 30-year-old professional football player, took his Ford Mustang Cobra to University Ford dba Bob Baker Ford, a car dealership, to have safety recall work performed. The service included removing the rear wheels of the car. After the vehicle was returned to Jones, he was told it had been given a test drive and was ready to go. After Jones drove approximately a quarter of a mile from the dealership, the left rear wheel of the car fell off while Jones was trying to drive onto a freeway on ramp. As a result of the wheel coming off, Jones hit his head on the interior of the car causing soft tissue injuries to his neck, with left arm impairment. At the time of the injuries, Jones was not a member of any professional football team.

Settlement Discussions

At a mandatory settlement conference, the defendant offered $15,000 which was rejected. The plaintiff demanded $450,000 which was rejected. The defendant countered with an offer of $25,000 which was rejected.

Damages

Pain and suffering, medical expenses, loss of earnings from professional football, loss of enjoyment as a professional football player.

Injuries

Jones suffered soft tissue damage to his neck, shoulder and left arm. He also suffered limited range of motion and radicular pain and loss of strength in his left arm and hand.
