Facts
On June 6, 2002, at 3:15 p.m., a 46-year-old grocery store employee, was driving a 1990 Ford Taurus in the parking lot of a Rite Aid Drug Store in Paso Robles. Her daughter, the plaintiff Younque Bales, age 12, was riding as a passenger in the front seat. The defendant Tony Davis was stopped in a 1999 Ford Expedition directly ahead of the plaintiff's vehicle. The defendant intended to exit the parking lot onto 24th Street. The defendant's front tires were on the pavement of 24th Street and he observed approaching vehicles on 24th Street. He checked over his shoulder but did not notice the plaintiff's vehicle behind him. The defendant put his vehicle in reverse and backed up and contacted the front of the plaintiff's vehicle. The defendant stipulated to negligence but argued that the impact was too minor to cause injury.
