Facts

The plaintiff, a 30-year-old financial planner, was proceeding along Costa Verde Boulevard in his BMW when the defendant, a student in her 20s, driving a GMC Jimmy, pulled out of a driveway in the plaintiff's path of travel. Liability was not in dispute. The plaintiff sustained soft tissue injuries, incurred reasonable and necessary medical expenses and lost two days of work. The defendant argued that the plaintiff's injuries were very minor and that loss of earnings were not recoverable as the plaintiff was paid on commission and there was no evidence of any commissions lost.
