Facts

The plaintiff, Jose Villalpando, 12, was at a public swimming pool with his family when a series of firecrackers went off. Villalpando was struck in the left eye with a bottle rocket. As a result, he suffered loss of vision in that eye. Jose and Gerardo Villalpando sued the City of Los Angeles for premises liability.
