Facts
In 2000, Mike Pirahanchi-Fard, a 55-year-old high school teacher, was driving his 1995 Honda Civic eastbound on Fassler Avenue in Pacifica when he was rear-ended by a 2000 Ford Explorer driven by Lidia Alcala. The impact caused the Honda to collide with a van in front of it. The Honda was towed from the scene and a police report indicated major vehicle damage. CSAA, Pirahanchi-Fard's insurance carrier, revealed photographs of the crash that indicated the car was crushed from the rear. CSAA paid the cash value of the car in the amount of $11,718. Pirahanchi-Fard sued Alcala, alleging vehicular negligence.
Settlement Discussions
The plaintiff demanded $85,000 and the defendant offered C.C.P. Section 998 for $11,501.
Injuries
The plaintiff suffered pain in the head, neck, mid and lower back as a result of the accident. He complained of headaches and dizziness. He received emergency treatment, physical therapy, neurologic consultation, acupuncture and yoga. The defendant also contended that the plaintiff suffered uncomplicated cervical and thoracolumbar strains.
