Frank Villescas, a-35 year-old cargo ship inspector, exited his apartment at the San Pablo Apartments in El Sobrante on Dec. 21, 2001, at 9:30 p.m. He tripped over a can of paint that had been left at the top of a stairway and fell down a flight of stairs.

Injuries

Villescas contended that he sustained a fractured left ankle, displaced oblique fibular fracture above his ankle joint with disruption of the syndesmotic ligaments and displacement of his ankle mortise. He alleged that these injuries were treated by open reduction with internal fixation by plating and syndesmosis screws. He claimed that he will require surgery to remove the hardware and will probably develop arthritis.
