Phyllis Chavez, a 36-year-old California Office of Employment Development employee, stopped her car at a traffic light in Redlands on Dec. 16, 2000. Her car was then rear-ended by that of 90-year-old Herbert McCLure. Two days after the accident, at 5 a.m., Chavez filed a police report at a local police station. An hour later, she went to an emergency room. She visited a chiropractor later that day. Chavez sued McClure, alleging vehicular negligence. McClure admitted liability, but disputed the extent of injuries and damages.
