Facts

Plaintiff Jillian Taylor, age 16, was driving her Nissan Sentra at the intersection of Green Valley Road and Lotus Road in El Dorado County. She was broadsided by a Ford Expedition driven by defendant G. Scott Conk and owned by defendant Allison Taylor. The plaintiff sued both Conk and Taylor, alleging vehicular negligence. The defendants did not dispute liability.

Settlement Discussions

The plaintiff made a C.C.P. Section 998 demand of $40,000; defendants made a C.C.P. Section 998 offer of $20,000.

Injuries

The plaintiff claimed she suffered soft-tissue sprains and strains to her neck and back. She claimed $16,000 in medical specials and damages for pain and suffering. The defendants contended that plaintiff suffered only minor soft-tissue injuries and needed no further care after two months of treatment. The defendants further argued that plaintiff's treatment was excessive and unwarranted.

Result

At trial, defendant Allison Taylor was voluntarily dismissed. The jury found in favor of plaintiff against defendant Conk, and awarded her $52,600.
