Facts

Defendant Biofriendly Corporation manufactured and processed fuel additives and fuel containing additives for distribution in the United States. Green Plus, a fuel additive, was manufactured by defendant. The plaintiff United States filed suit for violation of Section 211 of the Clean Air Act.

Contentions

PLAINTIFF'S CONTENTIONS:
The U.S. contended that the defendant did not properly register Green Plus under Section 211 of the Clean Air Act and introduced the product into commerce without this registration.

DEFENDANT'S CONTENTIONS:
The defendant denied all allegations.

Result

The U.S. agreed to a civil settlement amount of $1,250,000.
