Facts
The plaintiff, Lora Foglesong, 50, underwent an eyelift and dermabrasion. During the surgery, while Foglesong was under anesthesia, her O2 saturation level dropped to 75 for several minutes. This resulted from improper monitoring by anesthesiologist Alan Dror. Foglesong suffered brain damage as a result of the drop. She sued Dror for damages.
Damages
The plaintiff, who had adopted and cared for eight special needs children, required assistance with their care after the surgery. The plaintiff's 64-year-old husband claimed damages for loss of consortium.
Injuries
The plaintiff suffered from short-term memory loss as a result of mild to moderate cognitive problems.
Result
The parties settled for $475,000. The parties were unable to reach a settlement during a prior mediation with Jay Horton Esq.
