Facts

The plaintiff is Donna Siegel-Sieff, a practicing attorney. She injured her ankles on a "step down" threshold in a spectator area at a skating rink. The defendants are the ice skating rink, Van Nuys Iceland Associates Inc., and the owner, Bandec Investments. The plaintiff claimed negligent design and maintenance. The defendants denied liability based on contributory negligence. They claimed it was an open and obvious danger.

Settlement Discussions

According to plaintiff, the demand was $100,000.

Injuries

The plaintiff claimed she suffered a fractured right ankle and sprained left ankle. She required a wheelchair for two weeks. She also claimed she had residual pain, weakness, and activity restriction. Medical specials were $7,100. Loss of earnings were $5,100. Future medical expense for anticipated surgery and future loss of earnings were also alleged. The plaintiff has residual arthritis.

Result

The parties settled at mediation for $47,500 before David Geffen, Esq.
