Facts
Plaintiff Hill's former boyfriend, defendant Miraftab, assaulted her in her Lompoc apartment after she returned home. At the time, Hill was speaking on her cell phone to her daughter who lives in another state. During the altercation, Miraftab shot Hill in the face, neck and chest with a taser gun and threatened her life. The Lompoc police arrived at Hill's apartment after Hill's daughter notified her sister who lives in Lompoc and she, in turn, called the police. When the police arrived, Miraftab shot and killed himself. At the time of his death, Miraftab's estate was worth approximately $207,320. The plaintiff contended that she was entitled to the assets in the estate.
Injuries
The plaintiff suffered from mental distress and soft tissue injuries.
Result
The parties settled for approximately $70,000 by agreeing to split the estate equally.
