Facts

Claimants Michael T. Anderson, Eric G. Christenson and Reach Financial Group made several allegations against respondents Robert W. Nichols, Stephan R. Pene, S.L. Reed & Company and Windward Capital Management. The allegations include breach of contract, intentional interference with contractual relations, violation of NASD and SEC rules and failure to supervise. This case involved the breach of a confidentiality settlement agreement entered into by claimant and respondents.
Respondents denied any wrongdoing and asserted various affirmative defenses.

Damages

Claimants sought declaratory relief regarding the rights and obligations of claimants as to disclosure of customer and related information arising under the settlement agreement. They also requested a permanent injunction against respondents from seeking to cause the wrongful disclosure of the claimants' confidential customer information by third parties. Claimants further sought unspecified compensatory damages, interest, costs and attorneys fees. Respondents requested dismissal of claimants' statement of claim of its entirety and costs, including attorneys fees.

Result

Respondents' motion to dismiss was granted and claimants' statement of claim was dismissed with prejudice. The parties beared their respective costs, including attorneys' fees.
