Facts
Sherry Wright worked as a security guard for Warner Bros. Studio Facilities. Her complaint alleged that security department officials failed to take appropriate corrective action in response to repeated complaints by Ms. Wright of unlawful sexual harassment by a supervising security guard during a one month period in 2005. After exhausting her administrative remedies with the California Department of Fair Employment and Housing, Ms. Wright filed suit against Studio Facilities.
Contentions
PLAINTIFF'S CONTENTIONS:
The plaintiff alleged that a supervising security guard began making sexual advances towards her shortly after they were assigned to work at the same studio gate. These advances purportedly included demands for sexual acts and unsolicited and unwelcome touching. The plaintiff claimed her supervisor intimidated and threatened her with discipline and the loss of her job if she did not comply with his requests.
DEFENDANT'S CONTENTIONS:
The defendant contended no sexual harassment occurred and that plaintiff had fabricated her allegations. Defendant also contended that it took prompt responsive action to a report made by plaintiff that her supervisor had treated her inappropriately.
Result
The jury returned a defense verdict. Studio Facilities has received a judgment for its costs. Its motion for attorneys' fees is pending.
