Facts
Plaintiff class was comprised of applicants for hourly sales associates, support associates and cashiers for Victoria's Secret retail stores located in California from March 29, 2002 until present. Plaintiff class sued for unfair trade practices and competition, failure to pay wages and conversion. The conversion cause of action was dismissed.
Contentions
PLAINTIFFS' CONTENTIONS:
The plaintiffs contended that defendant imposed uncompensated job training as well as job previews. Further, plaintiffs claimed that defendant mandated applicants to undergo a "sales tryout," which imposed training and work without providing pay.
DEFENDANT'S CONTENTIONS:
The defendant denied plaintiffs' allegations.
Injuries
The plaintiffs sought unpaid wages.
Result
The parties settled for $10,000,000. Specifically, each class member will be issued a gift card for $67.50. $5,000 will be awarded to each named plaintiff. The court also awarded $2.89 million in attorney fees and $148,402.82 in costs.
