Facts

Mr. Tuna Inc. was a New York-based seafood company that sold canned fish products bearing the mark "King of the Sea" on its website kingoftheseatuna.com and the website Amazon.com. Tri-Union Seafoods LLC sued Mr. Tuna for trademark infringement, claiming that Mr. Tuna's "King of the Sea" infringed Tri-Union's famous "Chicken of the Sea" mark and constituted a breach of the parties' written settlement agreement from a prior litigation.

Result

A $9.8 million judgment was rendered in favor of Tri-Union.
