Facts

In the early morning hours of Aug. 20, 2013, plaintiff Wendy Huling Ng, 25, was driving her vehicle when defendant commercial truck driver, Sukhdip Singh, collided head-on with plaintiff.

Contentions

PLAINTIFF'S CONTENTIONS:
Plaintiff contended defendant lost control of his vehicle, veered to the right onto the sidewalk, and then over-corrected by veering sharply to his left across the median into oncoming traffic and head-on into plaintiff's vehicle.

An investigation showed that defendant had been driving all night and was less than 15 minutes away from the place of his employment and exceeding the 10-hour commercial vehicle driving limitation when the accident occurred. Plaintiff argued that the driver denied falling asleep, while conceding that there was no medical or mechanical condition, which could have contributed to the collision.

DEFENDANT'S CONTENTIONS:
Defendants Sukhdip Singh and Guru Trans Inc. admitted liability for causing the collision but contested plaintiff's injuries.

Injuries

Plaintiff claimed to have suffered pain and scarring on her face. She suffered a C2 fracture, which was treated with a halo, along with injuries to her head and face.

Result

The case settled for $925,000.
