Living Assistance Services Inc. dba Visiting Angels filed an infringement lawsuit against Visiting Angels Home Health Services Inc. and Naira Tshorokhyan.
Result
The parties agreed to enter into a consent judgment, under which, defendants agreed to no longer use the "Visiting Angels" mark or anything confusingly similar to that mark. Defendants were also required to remove all references to that mark from its websites, and to stop using the mark on any promotional or marketing materials. In addition, defendants were required to change its trade name to remove "Visiting" or "Angels" or the terms "Visiting Angels" or "Living Assistance Services" to its new name. Defendants were also required to comply with the other terms outlined in the consent judgment. In addition, the consent judgment also required defendants to pay $100,000 in damages, per violation if defendant fails to comply with any of the provisions or term under the agreement.
