PLAINTIFF'S CONTENTIONS:
Bowman alleged that on Sept. 29, 2010, she was stopped at an intersection, when a vehicle driven Zarate rear-ended her vehicle. She argued that defendant drove negligently because he should have observed her while stopped at a red light and was driving 55 miles per hour.
DEFENDANT'S CONTENTIONS:
Defendant argued that the vestibular deficit and oscillopsia that plaintiff claimed were not caused by trauma because they were not accompanied by hearing loss or severe head injury. Also, defendant argued that the vestibular loss did not occur until much later than the accident.
Damages
Plaintiff sought past medical costs of $30,638.02, $63,407 for future medical costs, $135,058 for past lost earnings, $550, 406 for future lost earnings and $283,361.80 for loss of future household services.
Injuries
Plaintiff claimed she suffered a concussion, oscillopsia, strain and sprains, vestibular deficit. She received physical therapy.
Result
The jury granted plaintiff $23,737.85.
