Facts

On October 21, 1992, Plaintiff, a 29-year-old student, was traveling eastbound on Victory Boulevard and was attempting a left turn onto northbound Sepulveda Boulevard while Defendant city's police officer was traveling eastbound in the westbound lanes of Victory approaching Sepulveda. The officer riding a motorcycle with his amber flashers activated struck Plaintiff's vehicle in a broadside collision at approximately 50 mph. The officer ejected from his cycle and later died. Plaintiff's vehicle continued in a northeast direction and mounted the curb, brushing a light pole on the corner. Defendant city's officer was in the course and scope of his employment.

Plaintiff contends that they demanded the arbitration award of $22,360 and that Defendant offered $6,500.
