On October 8, 1990, Plaintiff Nelson R. Parrott, a 33-year-old owner/proprietor of a family plumbing business, was driving his plumbing truck when he stopped for pedestrians on Sunset Boulevard. Plaintiff's vehicle was then struck in a rear end collision by Defendant Four Winds Day Camp's van. The force of the collision allegedly caused Plaintiff to go forward and strike the steering wheel with his mouth and shoulder, breaking the steering wheel. Plaintiff had been wearing a lap belt. Liability was not disputed.

Plaintiff contends he demanded $250,000 and Defendants offered $150,000. Defendant contends they offered $150,000 cash or a structure with a payout of $367,000; and Plaintiff demanded $500,000 reduced to $250,000 on the day of trial.
