Facts
On February 16, 1993, at approximately 2:00 p.m., Plaintiff, a 42-year-old dock clerk, had been dispatched by her payroll company employer to work for Defendant special employer. A 500-pound steel drum was being loaded by Defendant transport company's employee to a stakebed truck. The transport company's employee then hurriedly loaded another drum onto the back of his stakebed truck, causing the pallet to become unbalanced and tip over a third drum. That drum crushed Plaintiff's right foot and ankle.
