Facts

Defendant developer built a 112-unit condominium project. The construction was completed in 1986, with an average purchase price per unit of $120,000. As a result of defects, Plaintiff homeowners association brought this lawsuit for strict liability, breach of warranty and negligence against the Defendant developer.

Settlement Discussions

Plaintiff contends it demanded $4,000,000 and Defendant offered $1,100,000 increased to $1,800,000 increased to $3,400,000.

Damages

Multiple roof leaks, improperly constructed exterior decks, stairs and landings, faulty installation of windows and a multitude of other significant construction defects; Plaintiff's estimated cost of repairs was $4,200,000 (Defendant's estimate was $1,100,000).
