Facts

On March 19, 1995, plaintiff Kristi Parriott, a 26-year-old waitress, parked her car at the curb on Melrose Avenue in Los Angeles. The plaintiff claimed that as she exited her car on Melrose Avenue, the mirror on defendant Peter Paskus' van struck her in the back as the defendant drove by. The plaintiff brought this action against the defendant based on a negligence theory of recovery.
