Facts
On May 2, 1995 at 5:30 p.m., a multiple vehicle rearend accident occurred in the car pool lane during evening rush hour on the eastbound 210 freeway in Pasadena. Vehicle 1 and vehicle 2 were involved in a rearend collision. Vehicle 3 came to a complete stop behind vehicle 2. The plaintiffs were in a truck, vehicle 4, that was stopped or slowing behind vehicle 3 when it was struck from behind by vehicle 5. The plaintiffs' vehicle went forward after the impact and struck vehicle 3. The plaintiffs' vehicle then continued traveling south across all eastbound lanes of traffic and struck a guard rail on the freeway shoulder. Vehicle 6 then struck vehicle 5. The plaintiffs brought this action against the drivers of vehicles 1,2,3, 5 and 6 and the plaintiff driver's employer, based on a negligence theory of recovery.

Injuries
Plaintiff 1, the driver, claimed he suffered a head injury, a concussion, lacerations requiring staples for closure, and upper body soft-tissue injuries. Plaintiff 1 also claimed he suffered temporary blurry vision and headaches and scarring on his scalp. Plaintiff 2 claimed he sustained upper body soft-tissue injuries.
