Facts

The plaintiff, a 26-year-old female, filed a lawsuit against a tanning bed manufacturer and salon after receiving severe burns to her body following a tanning session. The defendants in the underlying action retained the defendant to perform an independent medical examination pursuant to C.C.P. Section 2032. The examination took place at the physician's home in a bedroom that was used for such examinations. The plaintiff's attorney was present for the entire physical examination. Following a settlement in the underlying case, the plaintiff's attorney filed the subject suit against the defendant physician.
