Facts
On Feb. 23, 2002, at approximately 1 a.m., the plaintiffs Erik Siddons and Sooyoun Kim, were celebrating Kim's birthday at the Mirabelle Restaurant on Sunset Strip, West Hollywood. They were walking towards the restaurant's restroom when someone in a group of customers pushed the plaintiff Kim. She yelled at the person not to push her, at which point the restaurant's bouncer allegedly grabbed her and forcefully tried to move her. When the co-plaintiff Siddons told the bouncer to let go of her, the bouncer punched him in the mouth. The plaintiffs contended that the bouncer then proceeded to grab them both by the neck and shake their bodies vigorously. Upon releasing his grip, they fell to the ground. The police were called and the plaintiff Siddons was taken to a nearby hospital.

Injuries
The plaintiff Siddons claimed that he had sustained a severe injury to his mouth, including broken teeth and temporomandibular joint dysfunction. Both plaintiffs claimed soft tissue injuries as well as severe emotional injuries.
