Facts

IN 2005, Eric Henrikson was seriously injured in a helicopter accident. He sued the French manufacturer of the helicopter, and received $26 million. He then sued his former employer, the County of Sacramento, in a dispute over his workers compensation benefits.

Contentions

PLAINTIFF'S CONTENTIONS:
Henrikson was the sole survivor of a Sacramento Sheriff's Dept. helicopter crash, and received serious injuries and brain damage. He was put on 100 percent disability status, and received permanent disability benefits.

However, the county later terminated his disability benefits, and sought credit from the $26 million judgment that Henrikson received from a third party. Henrikson argued that the county was not entitled to any portion of that judgment.

DEFENDANT'S CONTENTIONS:
The county asserted that it had a lien on any recover that Henrikson received from the third party as a result of the helicopter accident.

Result

The court found that it lacked jurisdiction over this dispute, and dismissed it.
