Facts
In May 1997, Caroline and Mary Anderson, as trustees of the Salander Trust, sold a 14-unit apartment
complex to the plaintiffs. As part of the real estate transaction, the trust provided the plaintiffs with a written
five year warranty as to the roof. The roof subsequently leaked.
When plaintiff attempted to obtain the benefit of the warranty, defendant Eddie Estrada made several promises
to come out and repair the roof, but did not show up. Plaintiff sued defendants Anderson and Estrada for
breach of contract, intentional misrepresentation, and negligent misrepresentation.
Damages
Plaintiff Russell Tracy offered as evidence of his injuries the fact that he had borrowed $50,000 from the Small Business Administration. He did not tender any evidence regarding the nature and scope of his damages, or how the $50,000 was spent.
