Facts

The plaintiff, age 42, while on the job and performing his duties as a fire marshall, walked down an exterior
stairway at the cityÆs fire administration building.
The plaintiff contended that while descending the stairs, he slipped and fell down the stairs because there was
no handrail. The stair did not have a handrail, in violation of Uniform Fire Code, Uniform Building Code and
the State Building Code.

Settlement Discussions

The plaintiff demanded $400,000. The defendant made no offer.

Injuries

The plaintiff sustained knee, ankle and back injuries.
