Facts

On Nov. 27, 1997, it was raining, and plaintiff, a 64-year-old security guard, was walking on the City of Los
Angeles sidewalk abutting the defendantÆs property. The plaintiff decided to cut across the corner of the
defendantÆs landscaped area to reach the abutting driveway. As plaintiff attempted to cross the landscaped
area, he tripped and fell due to a 12-18 inch cement mass used approximately 10 years before to support a sign
post.
