On March 25, 1998, at approximately 12:30 p.m., plaintiff, a pedestrian, got off a bus on Broadway, northbound
at the intersection of 4th and Broadway. He proceeded back towards the intersection. While crossing
Broadway, he was struck by the defendant, driving a 1991 Toyota Previa van.

Settlement Discussions

At pre-trial settlement discussions, the plaintiff demanded $80,000, the defendant offered $45,000. At trial, the plaintiff asked the jury for $232,000, the defendant asked for a defense verdict.

Specials in Evidence

Past medical specials were agreed to pursuant to the Hanif v. Superior Court decision due to Medicare write-off. Specials were $9,888. $25,000 (knee replacement which would be proceeded by $15,000 to have the hardware removed)

Injuries

The plaintiff suffered a comminuted fracture of the left patella and knee and required emergency surgery which included internal fixation and a plate with nine screws, the hardware still intact as of the date of trial. The plaintiff claimed a soft tissue injury and a permanent back problem as a result of the impact.

Other Information

The case was arbitrated, with an award to the plaintiff for $42,000. The plaintiff requested a trial de novo.
