On March 31, 1998, decedent Bruce McKinzie pulled over on shoulder two feet north of the fog line
approximately 30 miles west of Blythe. He was attempting to tie down a loose tarp on his flatbed trailer when
he was struck by defendant Mitchell Lee Kirkwood, who was employed by defendant Timely Transportation
Inc., and driving a conventional freightliner.
Bruce McKinzie died at the scene.
The plaintiff, the decedentÆs wife brought this wrongful death action against the defendants.
Settlement Discussions
At the mandatory settlement conference, the plaintiff told the defendants that she would take $850,000. The defendant made a C.C.P. Section 998 offer of $221,000.
