Facts

Defendant Escobedo's truck broke down on the 163 freeway in heavy evening traffic. Escobedo allegedly failed to activate the lights on the truck, and the vehicles behind the truck began to collide. The plaintiff, who was driving with his wife, claimed that he was hit from behind by defendant Barrie. Plaintiff Javier Seturino claimed injury to his lower back. Plaintiff Mercedes Seturino claimed soft tissue injuries to her neck and back. The defendants denied liability and the plaintiff's claimed injuries.
