On March 15, 1998, defendant taxi driver rear-ended plaintiff, while plaintiff was stopped in traffic. The plaintiff sued the taxi driver and owner alleging general negligence and motor vehicle causes of action.

Injuries
The plaintiff, a 61-year-old live-in cook, sustained soft tissue injuries, bruises and headaches. Headaches and nausea persisted. The next evening, the plaintiff lost consciousness, was rushed to the hospital and was diagnosed with subdural hematoma and underwent emergency brain surgery. The plaintiff required several months of rehabilitation and continues to have weakness in the left arm, leg and left side, problems with balance, concentration, short-term memory and stamina, sensitivity at site of incision, and other problems directly attributable to the brain injury and surgery.
