Facts
The plaintiff, the purchaser of a life insurance policy, sued the agent who sold him the policy, Gabriel P. Minotta, and the policy's issuer, The Manufacturers Life Insurance Company. Manufacturers Life settled with the plaintiff. After Minotta refused to contribute to that settlement, Manufacturers Life filed a cross-complaint against Minotta for his actions and omissions in connection with the sale of the policy. Manufacturers Life's cross-complaint raised claims of breach of contract, negligence and indemnity.

<A>After a non-binding arbitration, Manufacturers Life was awarded almost $125,000. Minotta requested a trial de novo. The jury rendered a verdict which, after applying comparative principles, resulted in an award of $205,500 in favor of Manufacturers Life.</A>
