On May 16, 2002, plaintiff Engracio Aragon, 47, was driving on his night-shift job for the postal service on the I-80 in Oakland. An unknown vehicle cut in front of the plaintiff's car, causing him to slow down. The plaintiff was then rear-ended by a vehicle driven by defendant Darryl Richardson. The plaintiff's car was severely damaged, and he hit his head on the window.

Settlement Discussions

The plaintiff made a C.C.P. Section 998 demand of $15,000. The defendant made a C.C.P. Section 998 offer of $8,500.
