Consuelo Saunders, a 62-year-old drug counselor, was driving her 2001 Kia Spectrum westbound on I-8 in San Diego when her car was struck from behind by a 1997 Eagle Vision driven by Patricia Santos. Saunders' vehicle sustained about $13,000 in damage and Santos' vehicle sustained about $7,000 in damage.

Injuries
Saunders claimed soft-tissue injuries to her knee, neck and back, as well as a closed head injury. She was treated by a neurologist and an orthopedist. She also received chiropractic treatment. She claimed that she continued to suffer from back and neck pain. Santos disputed the nature and extent of the injuries. She claimed that Saunders had injured her back several weeks before the accident when she fell off a ladder and that Saunders failed to disclose that accident to her treating physicians.
